1. Acceptance of the Terms

By registering for, accessing or using Comercios Pinoleros (the "Platform"), you agree to these Terms of Use. If you do not agree with them, you must not use our services.

These Terms apply to the web platform, the Android application and any other official Comercios Pinoleros services that may be made available in the future.

2. Description of the Service

Comercios Pinoleros is a business management and digital presence platform designed for small and medium-sized businesses.

• Create and manage businesses under one account, subject to the limits of the selected plan.
• Manage products, categories, prices, costs, stock and inventory.
• Record and review in-person sales and online orders.
• Manage customers, store credit, credit tabs, payments and outstanding balances.
• Generate receipts, reports, charts and business performance information.
• Publish business information, opening hours, location, products, promotions and a public catalog.
• Invite team members and manage roles or permissions where supported by the selected plan.

3. Registration and Account Security

• You must provide accurate, complete and up-to-date information.
• You are responsible for keeping your credentials confidential and for activity performed through your account.
• You must notify us if you detect unauthorized access or a potential security compromise.
• We may limit, suspend or terminate accounts when these Terms are violated or when required for security, fraud prevention or legal compliance.

4. Businesses and Published Content

Users may create and manage one or more businesses according to the features and limits of their plan. Each user is responsible for the information published about their businesses.

• Business name, description, category and commercial information.
• Products, prices, images, promotions and availability.
• Location, opening hours, phone number and other contact information.
• Payment methods accepted by the business.

5. Sales, Orders and Customer Payments

Comercios Pinoleros allows businesses to record sales and, where available, facilitates orders between customers and businesses. The Platform does not act as a buyer, seller, bank, financial institution or payment processor for sales made by businesses.

Payments for products or services are made directly between the business and its customer using the payment methods they agree upon. Comercios Pinoleros does not hold or receive funds related to those sales.

Displaying a payment method on a business profile does not mean that Comercios Pinoleros processes, guarantees or supervises that transaction.

6. Plans and Subscriptions

Comercios Pinoleros may offer a free plan and paid subscription plans. Commercial plans may be identified as Free, Pro and Business.

Current features, limits, prices, billing periods and availability are shown on the pricing page or during the subscription process. This commercial information may be updated without requiring the entire Terms of Use to be rewritten.

Where applicable, changes affecting an active subscription will be communicated within a reasonable period before taking effect.

7. Subscription Payments

Payments made to Comercios Pinoleros relate exclusively to access, capacity or features included in the subscribed plan and are separate from sales carried out by each business.

We may use third-party providers to process subscription payments. Those providers may apply their own terms, privacy policies and security measures.

Comercios Pinoleros does not charge a commission on each sale recorded by a business unless this commercial policy is expressly changed and communicated in the future.

8. Renewal, Plan Changes and Cancellation

Subscriptions renew according to the billing option selected during purchase. Users may cancel a subscription through the options available in their account or through official support channels.

Cancelling a subscription does not necessarily delete the account. Where technically possible, the account may continue under the Free plan or become subject to the applicable limits once the paid period ends.

Refunds, when applicable, are governed by applicable law and by the conditions disclosed during the subscription process.

9. Store Credit, Credit Tabs and Payments

Credit tab, store credit, payment and outstanding balance features are administrative tools used to record information provided by a business.

Comercios Pinoleros does not grant credit, lend money, guarantee repayment or act as a creditor, debtor or financial intermediary between a business and its customers.

10. Sales, Inventory and Reporting Information

The Platform provides tools to support business management. Users are responsible for verifying the accuracy of data they enter, including stock, prices, movements, sales, balances and reports.

Reports and receipts generated by the Platform do not replace accounting, tax, legal or professional controls that may be required under applicable law.

11. Tax and Business Obligations

Each business is responsible for complying with its own tax, accounting, commercial, employment and regulatory obligations. Comercios Pinoleros does not provide tax, accounting or legal advice through the Platform's standard features.

12. User Content

• You retain ownership of the content you upload or record on the Platform.
• You grant us a limited, non-exclusive authorization necessary to store, process, display and transmit that content in order to provide the service.
• You are responsible for having the necessary rights to images, trademarks, descriptions and any other content you publish.
• Information configured as public may be displayed to visitors and other Comercios Pinoleros users.

13. Acceptable Use

When using the Platform, you agree not to:

• Publish illegal, fraudulent, defamatory or infringing content.
• Use Comercios Pinoleros for deceptive, fraudulent or unlawful activities.
• Attempt to access accounts, systems, infrastructure or third-party data without authorization.
• Introduce malware, malicious code or mechanisms intended to disrupt the Platform.
• Reverse engineer, decompile or attempt to extract source code except where expressly permitted by law.
• Use bots, scrapers or other automated mechanisms without authorization where they affect security, availability or service operation.
• Intentionally overload infrastructure or bypass technical limits established by the Platform.

14. Android Application and Web Platform

Comercios Pinoleros is available through a web platform and an Android application. Certain features, interfaces or capabilities may vary depending on the device, operating system, app version or subscribed plan.

Availability of a feature on the web does not necessarily mean that it is available in exactly the same form on Android, and vice versa.

15. Third-Party Services

The Platform may use third-party services for authentication, infrastructure, storage, email, notifications, analytics, monitoring and subscription payment processing.

These integrations may be subject to the terms, policies and availability of the relevant provider.

16. Service Availability

We work to keep Comercios Pinoleros available and operating properly, but we do not guarantee uninterrupted or error-free operation.

Service interruptions may occur due to maintenance, updates, technical failures, third-party providers, security incidents or circumstances beyond our reasonable control.

17. Intellectual Property

The software, design, brand, logos, interface, documentation and other proprietary elements of Comercios Pinoleros are protected by applicable intellectual property laws.

These Terms do not transfer ownership rights in the Platform to the user; they only grant a limited right to use the service in accordance with these Terms.

18. Suspension, Termination and Account Deletion

Users may request cancellation or deletion of their account through available features or official support channels.

We may suspend or restrict an account when these Terms are violated, fraudulent activity is detected, there is a security risk, a legal obligation applies, or action is reasonably necessary to protect users or third parties.

Data deletion will be handled in accordance with our Privacy Policy and any applicable legal or technical retention obligations.

19. Limitation of Liability

Comercios Pinoleros provides technology tools for business management. We are not a party to agreements, sales, collections, debts, products, services or disputes that may arise directly between a business and its customers.

To the extent permitted by applicable law, we are not responsible for losses caused by incorrect information entered by a user, reasonable service interruptions, third-party failures or business decisions made solely on the basis of data entered into the Platform.

Any monetary limitation of liability will apply only to the extent permitted by applicable law.

20. Changes to These Terms

We may update these Terms when necessary to reflect changes to the Platform, features, business model, providers or legal requirements.

When changes are material, we may communicate them through the Platform, email or another reasonable method. The last updated date will appear at the top of this page.
